We recommend reading
carefully the General Conditions and Information of AVINSA TIKALTRAVEL
in order to avoid any problem or disappointment. The General Conditions
and Information are part of the binding contract between you and AVINSA
TIKAL TRAVEL.
1. TERMS OF CONTRACT:
With the acceptance of your booking in writing by phone or personally,
an official contract between you and Avinsa Tikal Travel, becomes effective.
2. RATES AND TERMS OF PAYMENTS:
2.1 RATES
All rates given are
in US$ and strictly net, if not otherwise requested. Rates are based on
current costs. We reserve the right to change the rates given without
prior notice. Additional Value and all other taxes assessed by the Government
of the countries in which services are provided or arranged are included.
Due to international currency exchange rate fluctuations and consequent
risk our invoice is binding in US$.
BOOKING
AND RESERVATION FEES
2.2.1 Every booking will have a nominal service charge of US $15 to cover
administrative cost.
2.2.2 We inform you that any additional administration at your request,
such as phone calls and faxes etc will be charged.
2.3. Terms of payment
2.3.1 For individual Travelers
2.3.1.1 Full prepayment is required 30 days prior to clients arrival unless
special arrangements have been made. If the prepayment does not reach
us in time we reserve the right to cancel without notice.
2.3.1.2 Additional Services (over prepaid amount) will be provided if
your prior agreement is given to pay our invoice for this additional immediately
upon receipt.
2.3.2 For groups the following payment policies will apply; Non-Refundable
Good-Faith deposit of US$ 800 or 25% of current balance upon acceptance
of offer. 50% of current balance eight weeks before groups scheduled arrival.
Full payment to be received in AVINSA TIKAL TRAVEL two weeks before the
group's arrival. Any additional charge incurred by the group during their
stay will be invoiced and has to be paid immediately upon receipt. Rooming
list due 45 days prior to arrival.
2.4 PAYMENTS
Payments should be made in us funds, checks made out to our accountant
and sent to her account, in a Bank in Miami. For wire transfers add a
fee of us $15. (Details on request)
2.5 CHANGE OF RATES
In some cases it is possible that the rates listed in the brochures might
be changed e.g.: Changed rates of transportation (gas, etc.) Changed port/airport
taxes or similar taxes levied locally. Changes and/or fluctuations of
currency exchange rates.
3. CANCELLATIONS/CHANGE OF RESERVATIONS
3.1. ADMINISTRATION FEES
Before Starting of
the cancellation dates (see 3.2.) we charge an administration fee of US$80
plus costs for phone calls and faxes.
3.2. CANCELLATION CHARGES
For individual traveler if a cancellation in writing is received by AVINSA
TIKALTRAVEL up to 7 days prior to commencement, all funds/prepayments
will be refunded in full, less the administration fee (see 3.1.) Additional
cancellation charges will be levied if cancellation is received later
as follows:
7 days prior to commencement: 30%
3-1 days prior to commencement: 50%
Less than 1 day prior to commencement: 80%
No refunds for "No Shows" and no refunds for unused portions
of the tour.
For various services different regulations may apply (e.g. Hotel reservations,
Train-Tickets, etc.) please contact us for any detailed information. Theatre/Opera
Tickets etc are Non-Refundable
3.2.2. FOR GROUPS
Group cancellations
will be accepted at no charge (except Good-Faith deposit US$ 800) up to
eight weeks prior to arrival. Cancellations received less than eight weeks
prior to arrival will be assessed the actual charges by hotels plus costs
of phone calls, faxes and administration.
4. LIABILITY

4.1. GENERAL
As an experienced incoming
Tour Operator we guarantee a careful selection and monitoring of companies
being involved in your travel itinerary (e.g. Hotel, Airlines, Shipping
lines, Coach Operators, Guide, etc.)
A correct information
and printing of the brochure at time of printing.
The professional organization
of your trip.
4.2. LIABILITY
AVINSA TIKAL TRAVEL, it's Tour Guides, its affiliates, assignees, cooperative
agents etc. act only as agents for the passenger with respect to transportation
and accommodation arrangements. They exercise every care possible, but
cannot be held responsible for personnel injury in connection with the
service of any airplane, train, automobile, carriage or any other conveyances
which is used in carrying out the booked arrangements. They cannot be
held responsible for delay accident, sickness, loss of personal property,
strikes, armed conflicts, additional expenses due to weather, disruption
of advertised schedules, refusal of visas, or other causes beyond their
control.
Further, the vehicles used in their tours are the full responsibility
of the companies or individuals engaged in the conveying of passengers.
5 OBJECTIONS AND COMPLAINTS
:
5.1. Should it not be possible
to execute a tour as promised or offered, we will make every effort possible
without taking liability for success to search for alternatives in order
to maintain the objective purpose and character of the tour.
5.2. Should you have any
reason for a complaint during the tour, you have to inform AVINSA TIKAL
TRAVEL, or one of our Tour Guides, Affiliates, assignees or cooperative
agents, immediately. This is a necessary supposition for a claim for refund
and will help in most cases for an acceptable solution.
5.3. Your claim for refund
together with the proof of the tour guides, affiliates, assignees or cooperative
agents has to be received at the AVINSA TIKALTRAVEL head office at the
latest 14 days after the termination of the tour in writing. Should you
not fulfill with these conditions your claim for refund will be forfeited.
6. CHANGES OF PROGRAMS
AND ITINERARY:
Unforeseen conditions may
necessitate tour changes and the right is reserved to make such changes
or withdraw the tours as deemed advisable.
7. EARLY TERMINATION
OF TOUR (PARTIALLY CANCELLED TOUR);
Should you have to partially
cancel your tour, AVINSA TIKAL TRAVEL will not be able to refund you for
the amount paid. However we will reimburse your for the cancelled services
which were not charged to us. We strongly recommend trip cancellation
insurance.
8. DOCUMENTS,
VACCINATION ETC :
It is your responsibility
to be informed about the entry and visa regulations for each individual
visited country. AVINSA TIKALTRAVEL can not be held responsible for refusal
of visas etc.
JURISDICTION
Present law in
Guatemala applies in any case of legal dispute, place of jurisdiction
is Flores, Peten, Guatemala.
